Mobile Privacy Policy

Time Study, Inc respects the privacy of our users. This privacy notice (“Privacy Notice”) describes how Time Study, Inc. (“Time Study”, “we”, “our” or “us”) obtains, uses and shares personal information and other information in connection with the operation of Time Study’s mobile application, products, and services (collectively the “Offerings”).  Our Offerings are used by enterprise customers, such as hospitals, to track practitioners’ time spent performing services to derive insights that drive progress.  Our enterprise customers enter into a contract and/or other applicable terms (the “Underlying Agreements”) with Time Study that govern their use of the Offerings as well as Time Study’s use of the personal information obtained in connection with the Offerings.  This Privacy Notice provides a general overview of Time Study’s data handling practices for our customers and we recommend reviewing the applicable Underlying Agreements for more details.


Please read this Privacy Policy carefully. IF YOU DO NOT AGREE WITH THE TERMS OF THIS PRIVACY POLICY, PLEASE DO NOT ACCESS THE APPLICATION.

We reserve the right to make changes to this Privacy Policy at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of this Privacy Policy. You are encouraged to periodically review this Privacy Policy to stay informed of updates. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Privacy Policy by your continued use of the Application after the date such revised Privacy Policy is posted. 

DEFINITIONS

“Access Credentials” means any user name, identification numbers, password, PIN or other security code or device used, alone or in combination, to verify an individual’s identity and authorization to access and use the Services. 

“Application” the mobile application that this policy applies to. 

“Authorized User” shall mean Customer’s employees or independent contractors who are authorized by Customer to access and use the Services under the rights granted to Customer pursuant of their signed MSA. 

“The Customer” is the organization or employing entity that has licensed Time Study products and identifies “Authorized Users”.

“Customer Data” means any and all information, data, materials, work, expressions, or other content, including any that are (a) uploaded, submitted, posted, transferred, transmitted, or otherwise provided or made available by or on behalf of Customer or any Authorized User for use of the Software; or (b) collected, downloaded or otherwise received by Time Study pursuant to this agreement, the Master SaaS agreement, or at the written request of Customer. All output, copies, workflows, reproductions, improvements, modifications, adaptions, translation, and other derivative works of, based on, derived from, or otherwise using Customer Data are themselves also Customer Data. For the avoidance of doubt, Customer Data includes all user data and personal information, but does not include Time Study materials. 

“Customer Systems” means the Customer’s information technology infrastructure, including computers, software, hardware, databases, electronic systems (including database management systems), and networks, whether operated directly by Customer or through use of third-party services. 

“Disabling Device” means any software, hardware, or other technology, device, or means used by Time Study or its designee to disable Customer’s or any Authorized User’s access to or use of the Services automatically with the passage of time or under the positive control of Time Study or its designee. 

“Master Saas Agreement” (or “the Agreement”) is the active contract between Time Study, Inc and “The Customer”.

“Permitted Use” means any use of the Services by an Authorized User for the purpose of entering, recording, and monitoring how Customer’s employees’ and other representatives’ time is spent at or in connection with customers work sites. 

“Services” means the software-as-a-service offering in both web and mobile form. 

“Customer Data” means any and all information, data, materials, work, expressions, or other content, including any that are (a) uploaded, submitted, posted, transferred, transmitted, or otherwise provided or made available by or on behalf of Customer or any Authorized User for use of the Software; or (b) collected, downloaded or otherwise received by Time Study pursuant to this agreement, the Master SaaS agreement, or at the written request of Customer. All output, copies, workflows, reproductions, improvements, modifications, adaptions, translation, and other derivative works of, based on, derived from, or otherwise using Customer Data are themselves also Customer Data. For the avoidance of doubt, Customer Data includes all user data and personal information, but does not include Time Study materials. 

COLLECTION OF YOUR INFORMATION

We may collect information about you in the following ways: 

Personal Data (“Authorized User”)

Personally identifiable information (such as your name, email address, and access credentials) that you or the Customer voluntarily give to us when choosing to participate in various activities in the mobile application. Please be advised that all data you disclose will be available to the Customer, as well as the Time Study team.

Derivative Data

Information our servers automatically collect when you access the Application, such as your native actions that are integral to the Mobile Application, 


USE OF YOUR INFORMATION

Customer Enablement

Time Study uses the information we obtain in connection with the operation of the Application and the provision of the Offerings for several purposes, including, but not limited to:

  • Making the Site and Offerings available (e.g., user account creation) and providing you with information or materials you may request (e.g., product demos);

  • Identifying, authenticating and managing user accounts for the Offerings;

  • Providing customer care and support for the Offerings;

  • Generating and analyzing statistics about use of the Site and the Offerings, including to provide usage information and improve the user experience for our Offerings;

  • Communicating with our customers and authorized users of the Offerings by email and other means, including sending informational, marketing and promotional communications about Time Study such as our newsletters;

  • For our marketing and advertising purposes, including interest-based advertising, relating to information collected on the Site;

  • Complying with and enforcing applicable industry and legal requirements (including legal process such as court orders, warrants or subpoenas) and fulfilling contractual obligations; and/or

  • Detecting, preventing, and responding to violations of this Privacy Notice, the Underlying Agreements, the applicable Terms of Use to the Site and Offerings, violations of law, fraud or theft, or other misuse of the Site or Offerings.

Records Retention and Access

To the extent required by law, until the expiration of four years after the furnishing of the Services which are the subject matter of this and the Master SaaS Agreement, Time Study shall, upon request, make available to the United States Department of Health and Human Services, the United States Comptroller General and their representatives (collectively, “HHS”) this and all other agreements, books, documents, and records as are necessary to certify the nature and extent of the costs incurred by the Customer. If Time Study provides such Services through a subcontract or consulting agreement worth $10,000 or more over a twelve-month period, the subcontract or consulting agreement shall also contain a clause permitting access by the HHS to the books and records of the subcontractor. Time Study shall give the customer notice of any request made directly by HHS upon Time Study. 

DISCLOSURE OF YOUR INFORMATION

By Law or To Protect Rights

If we believe the release of information about you is necessary to respond to legal process, to investigate or remedy potential violations of our policies, or to protect the rights, property, and safety of others, we may share your information as permitted or required by any applicable law, rule, or regulation. This includes exchanging information with other entities for fraud protection, potentially illegal activities or misuse of the Site and Offerings, intellectual property infringement or other violations of law, this Privacy Notice, the Master SaaS agreement, and applicable Terms of Use denote. 

Interactions with Other Users 

If you interact with other users of the Application, those users may see your name and descriptions of your activity. This is limited to users within the Customer associated with the usernames. 

Sale or Mergers

To the extent reasonably necessary to proceed with the negotiation or completion of a merger, acquisition or sale of all or a portion of our assets (including in the event of a reorganization, dissolution or liquidation).

Third-Party Service Providers

We may share your information with third parties that perform services for us or on our behalf, including payment processing, data analysis, email delivery, hosting services, customer service, and marketing assistance. Or for any purpose with your consent or otherwise at your direction.


TRACKING TECHNOLOGIES

Cookies and Web Beacons 

Time Study and our service providers may also collect certain information when you utilize the Site and Offerings, including through cookies, web beacons, software development kits (SDK’s) and other technologies (collectively “Cookies”). We and our service providers use Cookies to administer and understand usage and improve our Site and Offerings.  We may also use Cookies to collect aggregate information about users such as technical information about browsers and devices used to access the Offerings and information about crashes or other technical issues.  The information collected for these purposes may be disclosed to or collected directly by our third-party web analytics service providers, such as Google Analytics.  For more information about the use of Cookies for Interest-Based Advertising, see here

SECURITY OF YOUR INFORMATION

We use administrative, technical, and physical security measures to help protect your personal information. While we have taken reasonable steps to secure the personal information you provide to us, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse. Any information disclosed online is vulnerable to interception and misuse by unauthorized parties. Therefore, we cannot guarantee complete security if you provide personal information.

Policy for Children

The Site and Offerings are not directed to, nor does Time Study knowingly collect personal information from, children under the age of 13.  If you become aware that your child or any child under your care has provided us with information without your consent, please contact us as indicated below. 

ADDITIONAL INFORMATION FOR CALIFORNIA RESIDENTS

Under California law, specific disclosures are required and California residents who access the Site may have additional rights regarding their personal information.  Please review this section to learn more.  The rights set forth below do not apply to authorized users of our Offerings.

  1. Your California Consumer Privacy Act of 2018 (“CCPA”) Rights Residents of California who use the Site may have the following rights with regards to information collected by Time Study in connection with the Site:

    1. Right to access your personal information.  You may request to access the categories and specific pieces of personal information that Time Study collected about you.

    2. Right to deletion.  Subject to certain exceptions, you may ask us to delete the personal information that Time Study collected about you.

    3. Right to disclosure.  You may request to receive additional details about the sources from which Time Study collects information, the reasons we collect and share information, and the types of third parties with which we share the personal information we collected about you.

    4. Right to opt out of sales.  Under CCPA, certain types of sharing of personal information may constitute a “sale” of your personal information.  We do not sell your personal information to third parties for their own commercial purposes.  To opt out of the use of your information for interest-based advertising, please use the opt outs included in the Interest-Based Ads Opt-Out section above.

    5. Right to be free from discrimination.  You may exercise any of the above rights without fear of being denied goods or services.

If you would like to exercise your CCPA rights with respect to the personal information we collected about you, including the right to opt out of the sale of your personal information, please contact us with your request by email at privacy@timestudy.co. For such requests, please put the statement “California CCPA Rights” in the body of your email, as well as your full name, email address, mailing address and specify the CCPA right you wish to exercise at this time.
